EE Photography LLC (“Photographer”)

Note: This page explains how I work so projects run smoothly. By booking a shoot or paying an invoice, you agree to these Terms & Services.
1) Booking, Scheduling & Access
A booking is confirmed when the invoice is accepted/paid and the shoot date is set in writing (email/text).
Access: Client is responsible for providing safe, lawful access (e.g., lockbox codes, gate instructions). If a homeowner or tenant will be present, please notify them in advance.
Realtor presence: If owners or tenants are on-site, having the realtor present is recommended for coordination, but not required.
Property readiness: Client ensures the site is photo-ready (staged, cleared, pets secure). Waiting time beyond a 15-minute grace may be billed at $25 per additional 15 minutes.
2) Safety, Weather & FAA Compliance
All flights comply with FAA Part 107 (including airspace authorization, night ops requirements, and VLOS).
Photographer will not fly in unsafe or unlawful conditions (high winds, storms, TFRs, restricted areas, over people/vehicles where not permitted, etc.).
Weather call: If conditions are unsafe, we’ll reschedule at no charge for the next available clear window.
3) Deliverables & Turnaround
Package deliverables are as listed on the Services page (e.g., “up to 15 edited photos,” “up to 60-second reel”). Final image/video selection is at Photographer’s discretion to best represent the property.
Turnaround:
Photos: within 24 hours
Photo + video: within 48 hours (business days)
Rush options:
Same-day booking (scheduled & shot within 24 hours): +$50
Same-day delivery: +$75 (subject to schedule/conditions)
Format: High-resolution JPGs for photos; MP4 (H.264/H.265) for video, optimized for web/MLS/social. RAW files are not provided unless agreed in writing.
Delivery method: Download link (Google Drive/Dropbox). Links remain active for 30 days; re-hosting after that may incur a $15 archival fee.
4) Revisions & Re-shoots
Includes light edits (exposure, color, crop, basic sky cleanup). Complex retouching, object removal, composites, or heavy edits may be quoted at $50/hour.
Re-shoots are billed unless due to Photographer error (e.g., technical failure). Weather or lighting preference changes are not considered error.
5) Deposits, Fees & Payments
Deposit: A 30% non-refundable deposit is required to confirm the booking.
The balance (including any add-ons or travel fees) is due upon delivery of final files unless otherwise specified in writing.
Payment methods: Secure card payment via Wave (online invoice), plus cash/check/Venmo/Square by arrangement. Processing fees may apply for certain methods.
Late payments: Invoices not paid within 10 days of delivery may accrue 1.5% per month (or the maximum allowed by law). Files may be withheld until payment clears.
Chargebacks/NSF fees: Client is responsible for any associated costs.
6) Travel & Expenses
Travel included within 25 miles of Vandalia, MI. Beyond that: $0.75/mi round trip.
Tolls, parking, and permit fees are billed at cost.
If access isn’t available within 30 minutes of arrival, the session may be canceled and up to 100% of the session fee charged.
7) Licensing & Usage Rights
Copyright remains with the Photographer.
Standard license (included): Non-exclusive, non-transferable, perpetual license to use delivered media for personal use or marketing related to the specific property/project (e.g., MLS listing, brokerage marketing, social media, print, website).
Restrictions: Client may not resell, sub-license, or reuse media for unrelated products, properties, or campaigns without written consent.
Brokerage/MLS: Media may be shared within the listing brokerage and MLS partners for marketing the same listing. Removal of metadata/watermarks or redistribution beyond the listing’s marketing may require additional licensing.
Extended licensing: National ads, third-party campaigns, multi-property use, exclusivity, or editorial resale require separate licensing/fees.
Portfolio use: Photographer may display work for self-promotion (website, social media, print). Client may request in writing that a property be excluded from public portfolio use.
8) Refunds, Cancellations & Rescheduling
Deposits
30% booking deposit is non-refundable.
If Client gives ≥48 hours’ notice, the deposit may be applied once to a reschedule within 30 days (subject to availability).
After one reschedule or beyond 30 days, the deposit is forfeited.
Client-initiated
≥48 hours: no additional fee; deposit may roll forward once.
24–48 hours: 25% of package price; deposit applies toward that amount.
<24 hours/no-show: 50–100% of package price depending on time/travel incurred. Documented travel or permit costs remain due.
Photographer-initiated
If Photographer cancels and cannot reschedule promptly, Client receives a full refund of all amounts paid for that shoot.
If partial work delivered and Client opts for a refund instead of a make-good, refunds are pro-rated for the undelivered portion.
Weather / Safety / Airspace
Unsafe flying conditions or FAA airspace restrictions will result in a no-fee reschedule to the next available clear window. Deposits remain applied.
After delivery
Because digital files are non-returnable, refunds are not issued after delivery except for verifiable technical defects (e.g., corrupted files).
Photographer will attempt to re-deliver or repair first; if not possible, a reasonable pro-rated refund may be issued.
Rush fees missed due to Photographer error are refunded; the base package remains due.
Refund timing
Refunds are returned to the original payment method within 5–10 business days (processor timelines may vary).
Disputes / Chargebacks
Client must contact Photographer within 7 days of issue and allow time to resolve before filing a chargeback.
9) Add-Ons & Custom Projects
The services and deliverables provided under this Agreement are limited to those explicitly stated in the selected package and invoice.
Small add-ons (extra angles, short additional clips, brief revisits within a week) may be billed at $50/hour.
Larger scopes (multi-location shoots, extended video edits, commercial campaigns, or exclusive use) will be quoted as Custom Packages.
10) Image Integrity & Disclaimers
Media depicts conditions as captured. Photographer does not certify measurements, boundaries, or condition.
Any property line overlays or map graphics (if provided) are illustrative only and not a legal survey.
Color and brightness may vary across screens or prints due to calibration differences.
Photographer is not responsible for MLS or platform compression/cropping.
11) Insurance & Liability
Photographer maintains commercial drone liability insurance. Certificate of Insurance available upon request.
Limitation of liability: To the fullest extent permitted by law, Photographer’s total liability for any claim is limited to the amount paid by Client for that project.
Photographer is not liable for indirect, incidental, or consequential damages.
12) Privacy & Data
Client contact details are used only for communication, invoicing, and delivery.
Download links are shared with Client and any authorized recipients designated by Client.
13) Independent Contractor; Miscellaneous
Photographer is an independent contractor. Nothing herein creates an employment, partnership, or joint-venture relationship.
These Terms, together with any invoice or quote, constitute the entire agreement and supersede prior discussions.
Changes must be made in writing.
If any provision is unenforceable, the remainder remains in effect.
Governing law: State of Michigan.
Disputes will first be addressed through good-faith negotiation; if unresolved, parties may pursue small claims or mediation.
E-signatures, email confirmations, and online invoice acceptance are valid and binding.
